2nd Appeals Court Rules DOMA Unconstitutional



Today, the second appeals court found the Defense ofMarriage Act unconstitutional. This act defines marriage as a union between one man and one woman. The reasoning for the ruling is that the DOMA denies rights to LGBT couples, a clear case of discrimination. The case will next be taken to the United States Supreme Court, but this is a land mark ruling. Same-sex marriage has been an issue for some time, most recently when President Bush pushed for a constitutional amendment defining marriage in 2006.

Joe Biden gave the issue more publicity with his comments about it earlier in the summer on the show “Meet the Press”. “I am absolutely comfortable with the fact that men marrying men, women marrying women, and heterosexual men marrying women are entitled to all the same exact rights, all the civil liberties. And, quite frankly, I don’t see much of a distinction beyond that.” There was a small fire storm over his comments at first, but the President supported Biden.

An Aside: This has been an issue that many American’s have been divided on. I am for the idea of Equal Marriage. I really can’t understand why people are against it politically. I don’t actually think people are against it for actual political reasons. I think the objection is based solely on religious and moral views. If you have a good argument against Equal Marriage that isn’t based in moral or religious views, I’d love to hear them.  Let’s face facts though, our constitution protects us from any religious or moral views from deciding policies.
